Guest WiFi Privacy Policy

Last updated: 2024-01-01

This Privacy Policy describes how WifiGetLeads LLC, doing business as WifiGetLeads ("WifiGetLeads," "we," "us," or "our"), and the participating venue (the "Venue") collect, use, and share your personal information when you register for and use the complimentary guest WiFi service at the Venue (the "Service"), and when you receive marketing communications you have signed up for. It should be read together with the Terms of Use at https://app.wifigetlead.com/policies/terms.

Our roles. The Venue decides how your information is used for its own marketing, and WifiGetLeads operates the WiFi portal and marketing platform as the Venue's service provider. WifiGetLeads also uses limited data for its own purposes of operating, securing, and improving the platform.

1. Information We Collect

Information you provide when registering: your name, email address, mobile phone number, date of birth, and any other information requested on the portal, along with your marketing choices (such as checking the SMS opt-in box) and your acceptance of the Terms of Use.

Information collected automatically when you use the Service: your device's MAC address and device type; connection events (date, time, duration, and frequency of your visits and WiFi sessions); the Venue location where you connected; network usage metadata needed to operate and secure the network; and your interaction with the portal, including whether the ad shown at login was viewed.

Information about messages we send you: delivery, open, click, reply, and opt-out events for emails and text messages sent through our platform.

We do not use the Service to read the content of your internet traffic, and we do not collect precise GPS location — your presence at the Venue is known simply because you connected to its WiFi.

2. How We Use Your Information

We and the Venue use your information to: provide and manage your WiFi access; send you marketing and promotional emails and, only if you separately opted in, marketing text messages (see Section 4 of the Terms of Use for the full SMS program terms); personalize offers, such as birthday promotions; measure visit frequency and campaign performance and produce analytics for the Venue; operate, secure, troubleshoot, and improve the network and platform, including preventing abuse and enforcing the Terms of Use; comply with legal obligations and respond to lawful requests; and maintain records of your consents and opt-outs, which we keep as proof of compliance.

3. How We Share Your Information

With the Venue you connected at. Your registration data and visit data are shared with that Venue, which may use them for its own marketing to you, consistent with your choices and applicable law. We do not share your data collected at one venue with other, unrelated venues for their marketing.

With service providers. We use third-party providers to deliver the Service — such as SMS delivery providers, email delivery providers, cloud hosting, and analytics — who process your information only on our instructions and for the purposes described here. Mobile opt-in data and SMS consent are not shared with any third parties for their own marketing purposes.

For legal reasons. We may disclose information when required by law, subpoena, or other legal process, or to protect the rights, safety, or property of users, the Venue, WifiGetLeads, or others.

Business transfers. If WifiGetLeads or the Venue is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction, subject to this Policy.

We do not sell your personal information, and we do not share it with third parties for cross-context behavioral (targeted) advertising.

4. Your Choices

Text messages: reply STOP to any message to opt out at any time, or contact us at contact@wifigetlead.com. Email: use the unsubscribe link in any marketing email. WiFi data collection: if you do not want your connection data collected, do not use the Service; you may also ask us to delete your data as described in Section 5. Opting out of marketing does not delete data we must keep to honor your opt-out or meet legal obligations.

5. Your Privacy Rights

Depending on your state of residence, you may have some or all of the following rights under state privacy laws: to know/access the personal information we have about you; to correct inaccurate information; to delete your personal information; to receive a portable copy of it; to opt out of sale of personal information or its use for targeted advertising or certain profiling (as stated above, we do not sell personal information or use it for targeted advertising); and to not be discriminated against for exercising these rights.

To exercise any of these rights, email contact@wifigetlead.com with the name, email address, and phone number you registered with, and the venue where you connected. We will verify your request using that information and respond within the time required by your state's law (generally 45 days). If we deny your request, you may appeal by replying to our decision, and we will respond to your appeal as your state's law requires; if your appeal is denied, you may contact your state Attorney General. You may use an authorized agent to submit a request on your behalf if the agent provides proof of authorization and we can verify your identity.

6. Data Retention

We keep registration and visit data for as long as needed for the purposes above — generally while the Venue remains our client and for a reasonable period afterward — unless you request deletion earlier. Records of your SMS consent and opt-out are kept for at least five (5) years for legal-compliance purposes, and suppression lists (records of who has opted out) are kept indefinitely so we do not message you again.

7. Security

We use reasonable administrative, technical, and physical safeguards to protect your information. However, no system is completely secure, and the guest WiFi network itself is an open network — as explained in the Terms of Use, transmissions over it are not encrypted by us. We cannot guarantee absolute security, and you provide information at your own risk.

8. Children

The Service and our marketing programs are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information through the portal, contact us at contact@wifigetlead.com and we will delete it. We do not sell the personal information of, or serve targeted advertising to, anyone we know to be under 16.

9. Opt-Out Preference Signals; Do Not Track

Because we do not sell personal information or engage in targeted advertising, browser-based opt-out preference signals (such as Global Privacy Control) and "Do Not Track" signals do not change how the portal processes your data. If our practices ever change, we will update this Policy and honor such signals as required by law.

10. Residents Outside the United States

The Service is operated in the United States and intended for use at U.S. venues. If you use the Service, your information will be processed and stored in the United States.

11. Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date above reflects the most recent version, and material changes will be posted on the portal or communicated as required by law. Your continued use of the Service after changes take effect constitutes acceptance of the updated Policy.
